Houston truck accident attorney Keith Purdue of Grossman Law Offices filed a wrongful death lawsuit on September 11, 2011 in Harris County’s 101st District Court (Cause No: 2011 57460) following a fatal truck accident that occurred last July. The incident unfolded as 59-year-old James Little was parked legally on the shoulder of Highway 290 to exchanged information with another motorist with whom he was involved in a minor accident only minutes before. Then, as stated in the lawsuit, “Suddenly and without warning, an 18-wheeler driven by William Edwards drove onto the shoulder and rear ended Mr. Littles vehicle. As a result of the impact caused by the 18-wheeler, Mr. Little was ejected from his vehicle and sustained life ending injuries.” His body came to a rest some 50 yards from the point of impact.

The lawsuit in question alleges the negligent actions of the truck driver and his employers were the proximate cause of the fatality, as stated, “…[defendant] breached this duty in one or more respects including, but not limited to: failing to maintain a proper lookout, failing to keep his vehicle under control, failing to control the speed of his vehicle, failing to take proper evasive action, failing to apply his brakes in a manner sufficient to avoid the accident, and/or failing to maintain a single lane of travel.” The lawsuit elaborates, “Defendant Carrizales Transportation is vicariously liable for the damages proximately caused to James Little and the Plaintiff by virtue of the negligent conduct of its driver/employee/agent…”
